FORMER SUNNYVALE DEPARTMENT OF PUBLIC SAFETY OFFICER SENTENCED TO ONE YEAR AND ONE DAY IMPRISONMENT
Officer Used Official Position To Gain Sexual Benefits From Korean Hostess Bars
SAN FRANCISCO/SAN JOSE /OAKLAND – United States Attorney Scott N. Schools announced that David Lee Miller, Jr., was sentenced today to one year and one day in prison for his involvement in two separate conspiracies to commit extortion under color of official right. This sentence is the result of an investigation by agents of the Sunnyvale Department of Public Safety, the San Francisco Office of the Federal Bureau of Investigation, and the Internal Revenue Service-Criminal Investigation Division.
Mr. Miller pleaded guilty on January 10, 2005 to two counts of conspiracy to commit extortion under color of official right, in violation of 18 U.S.C. § 1951(a). According to the plea agreement, Mr. Miller admitted to using his position as a police officer to provide inside information regarding law enforcement activities against the clubs, protection from possible law enforcement activities, and debt collection assistance with respect to current and former club employees, in exchange for money, trips, and access to sex with the female employees of the clubs.
The sentence was handed down by U.S. District Court Judge Ware following Mr. Miller’s guilty pleas to two counts of conspiracy to commit extortion under color of official right, in violation of 18 U.S.C. § 1951. Judge Ware also sentenced the defendant to a term of three years supervised release. The defendant will begin serving the sentence on June 29, 2007.
Jeff Nedrow is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Susan Kreider. The prosecution is the result of a two-year investigation by the Sunnyvale Department of Public Safety, the San Francisco Office of the Federal Bureau of Investigation, and the Internal Revenue Service-Criminal Investigation Division.
