CHICO MAN INDICTED FOR RECEIVING AND POSSESSING CHILD PORNOGRAPHY
SACRAMENTO-- United States Attorney McGregor W. Scott announced today that a federal grand jury returned a six-count indictment charging ROBERT EDWARD LANDRY, 21, of Chico, with receiving and possessing child pornography.
This case is the product of a joint investigation by the Federal Bureau of Investigation and the Chico Police Department, with the assistance of investigators of the Butte County District Attorney's Office, as a part of Project Safe Childhood (PSC). Project Safe Childhood is a United States Department of Justice initiative established to increase federal prosecutions of violent sexual predators of children, and to reduce the incidences of Internet crimes against children including child pornography trafficking. As a part of PSC, the United States Attorney’s Office has teamed with state and local agencies to enhance law enforcement's presence on the Internet, and to educate the public and children about safe Internet use, thereby reducing the chance children will fall prey to online sexual predators.
According to Assistant United States Attorney Camil A. Skipper, who is prosecuting the case, the indictment alleges that LANDRY received visual depictions of minors engaged in sexually explicit conduct on various dates during summer 2006. The indictment also alleges that LANDRY possessed such images and seeks to forfeit to the government the computer on which he possessed the illegal material.
The maximum statutory penalty for each count of receiving visual depictions of minors engaged in sexually explicit conduct is 20 years in prison, with a mandatory minimum sentence of 5 years. The maximum penalty for possessing such depictions is 10 years imprisonment. However, the actual sentence will be determined at the discretion of the court after consideration of the Federal Sentencing Guidelines, which take into account a number of variables, and any applicable statutory sentencing factors.
