Truck Driver Indicted on Murder Charges

LOS ANGELES – A commercial truck driver whose big rig crashed April 1 in La Canada Flintridge, killing a father and his 12-year-old daughter, pleaded not guilty to murder and other charges in a Grand Jury indictment unsealed today.

The indictment (BA332046) was returned June 11 and unsealed this morning after Marcos Barbosa Costa, 44, was arraigned before Los Angeles Superior Court Judge Patricia Schnegg in Department 100 at the Criminal Justice Center.

Costa, who earlier was released on $200,000 bail, was rearrested this morning outside the Pasadena Court House where he was scheduled to appear for a preliminary hearing setting. Judge Schnegg set bail at $2.09 million on the indictment. The Massachusetts resident remained in custody.

Deputy District Attorney Carolina Lugo of the Pasadena Branch Office said investigators developed additional information that was presented to the Los Angeles County Grand Jury. Because the Grand Jury transcripts remain under seal, prosecutors cannot comment further.

In addition to two counts of murder, the indictment adds great bodily injury allegations to two counts of vehicular manslaughter. He also is charged with three counts of reckless driving causing specified injury to three victims, two of whom suffered concussions and one who sustained a bone fracture.

Costa was originally charged April 3 with two counts of vehicular manslaughter following the crash that killed Angel Posca and his daughter, Angelina. That complaint was later amended to add three counts of reckless driving causing specified injury. That case, GA076393, will be dismissed.

Costa was ordered to return to Pasadena Superior Court June 24 at 1:30 p.m. for a bail review hearing and pretrial conference. If convicted, he faces up to life in prison.
