Man Pleads Guilty To Sale Of An Unapproved Medical Device

United States Attorney Karen P. Hewitt announced that Bruce Perlowin pled guilty today before U.S. Magistrate Judge Louisa S. Porter to the sale of an unapproved medical device. In connection with his guilty plea, Perlowin admitted that he sold the “Energy Wellness” machine from his home and shipped it to people throughout the United States between October 15, 2002 and March 16, 2005, without the proper approvals from the Food and Drug Administration to distribute the Energy Wellness machine as a medical device. Based on his plea of guilty, Magistrate Judge Porter sentenced Perlowin to serve one year of probation and to pay a $250 fine.

According to Assistant U.S. Attorney Melanie K. Pierson, who prosecuted the case, the defendant admitted that he sold the Energy Wellness machine as a medical device. The device consisted of a micro-current frequency generator with a digital readout, two stainless steel cylinders, two personal application plates with connectors, and a lead wire for the cylinders and plates. Users were provided with an operating manual for the device that set forth more than four hundred digital settings focusing on specific conditions such as abdominal pain, AIDS, diabetes, stroke, and ulcers and worms. Users were advised to connect the cylinders or plates to the machine, and touch them to the body for a recommended run time to treat each condition.

The case was investigated by the U.S. Food and Drug Administration Office of Criminal Investigations.
