Teenage Boy Charged with Murder of 13-Year-Old Victim

LONG BEACH – A 17-year-old boy was charged with murder today in connection with the stabbing death of a 13-year-old victim, the District Attorney’s Office announced.

Heriberto Garcia (08/25/91) was scheduled to be arraigned this afternoon in Long Beach Superior Court, Dept. 6. The defendant is charged in case No. NA074833 with an allegation that the murder was street gang related.

Garcia and six other minors have been linked to the murder of Jose Cano on June 26, 2007. Also named in the amended complaint is Eva Daley, the 30-year-old mother of an alleged local gang member. Daley allegedly drove the youths to the park knowing they intended to kill the victim, according to Long Beach Police Department officials.

Preliminary information indicated that the stabbing was gang-related and that it was the result of at least one previous confrontation between the victim and members of a local gang. Police said the victim was involved in a fight between two groups of gang members at the park the day of the killing. Cano suffered multiple stab wounds to the upper body.

Garcia and Daley face life with the possibility of parole. Earlier this week, a judge found Garcia unfit to be tried as a juvenile.
